'JC to investigate May 9': SCPI gives more time to submit additional documents

Islamabad: On Friday, a constitutional bench of the Supreme Court gave the Pakistan Tehreek -e -Insaf (PTI) time to submit further documents during the hearing of the petition for the formation of a Judicial Commission (JC) to investigate the May 9 tragedy.

A five -member constitutional bench, headed by Justice Aminuddin Khan, heard the arguments presented by PTI founder’s lawyer Hamid Khan.

Justice Khan asked the lawyer what his client had made in the petition. Advocate Khan said that the applicant requested the establishment of a judicial commission comprising the Chief Justice and two senior Supreme Court judges to investigate the May 9 incident. Another request was to stop the trial of civilians in military courts, he added.

Justice Muhammad Ali Mazhar remarked that the petition regarding the trial of civilians in the military courts has already been contradictory, as a separate case is already being heard on the matter.

He asked the lawyer whether the issue of forming a judicial commission could be considered under Article 184, Article 3 of the Constitution. Advocate Khan replied that the May 9 incident was a national tragedy but no judicial inquiry has been made.

Justice Mazhar asked him whether he had requested the establishment of a judicial commission in the case of civilians in the military courts. To which Hamid Khan responded negatively.

Justice Jamal Khan Mandokhel remarked that in the petition, it was mentioned that dozens of civilians were killed on May 9. Have you attached the death certificate of any of those killed with the request, Justice asked the lawyer? Justice Khan asked him if a private complaint was filed about the civilian deaths. Any FIR was registered.

Justice Aminuddin Khan raised the question whether a private complaint has been lodged about civilian deaths. If an FIR has been filed, show it.

Justice Hassan Azhar Rizvi advised that media reports regarding the deaths of ordinary citizens on May 9 could be presented instead. Later, the bench gave PTI more time to submit additional documents and adjourned the hearing indefinitely.

The CB of the Supreme Court adjourned the hearing indefinitely, and gave the PTI time to submit more documents.
