JCP Eighth to select two more SC judges

Islamabad: Chief Justice of Pakistan (CJP) Yahya Afridi called for a meeting of the Judicial Commission of Pakistan (JCP) on April 8 to help the appointment of two new Supreme Court judges from the five nominations received from the Lahore High Court (LHC).

According to the agenda of the meeting, two of the five senior LHC judges will be elected to the new SC judges.

The JCP will also consider the request of LHC’s senior post Judge Shuja Ali Khan to exclude remarks/observations in the minutes of the JCP meeting on July 2, 2024.

During this meeting, the JCP unanimously approved the nomination of Justice Aaliyah Neelam as Chief Justice of the new LHC, Justice Shujat Ali Khan and Justice Ali Baqir Najafi, and approved the nomination.

The JCP noted that the judges were not appropriate and appropriate to hold the post of Chief Justice of the LHC “to a large extent because of his integrity and credibility in the judicial and legal community.”

He said in a complete and clear conversation, that all the members of the commission either described this theory or endorsed that “there is a universal harmony near the negative impression, then no expectation is displaced, and the nominee does not need to move forward.”

The JCP minute states that the basic power of the judicial institution is public confidence. “All members of the commission believed that the person who should be appointed as the Chief Justice of the High Court must own integrity and reputation.”

Justice Muneeb Akhtar, a member of the JCP, noted that the El Jihad Trust case has ruled a fundamental rule of constitutional law and is a bound.

However, a legitimate expectation, though, can be displaced by a high limit, if there are convincing reasons.

Justice Yahya Afridi had pointed out that two senior LHC judges were not considered appropriate for the elevation of the Supreme Court of Pakistan at the JCP meeting on June 7. Therefore, they should no longer be considered as Chief Justice of the LHC.

“The chairman (former CJP Qazi Phase Isa) stated that he personally cannot comment on the integrity and credibility of the first two gentlemen.

“However, with regard to Justice Shujat Ali Khan, he was disappointed with the limited experience of his work and his production was disappointing.

He said that some of his decisions were also cited which the Supreme Court had put aside as the legal principles were not followed.

He said that with regard to Justice Ali Bakr Najafi, the Chairman/CJPISA cited a large number of electricity rates in which the jurisdiction was assumed without legal/constitutional justification.

Referring to the Chief Justice Jesus, he said that another decisions of Justice Najafi have the capacity to remove the general elections of February 8 from the tracks, and a decision has been made by the SC to make an extraordinary influence.

The coalition government, led by the present Muslim League -N, increased the total power of SC judges from 17 to 34 through the 26th Constitutional Amendment. Currently, 22 permanent judges are working in SC.
