Islamabad: Senior Supreme Court Judge Justice Syed Mansoor Ali Shah canceled a planned visit to Saudi Arabia, which requires the departure of a former Pakistan to participate in two programs in arbitration, which is between the ongoing ‘Cold War’ in the Supreme Court. ‘

According to reports, Justice Shah was invited to provide key notes in two incidents a week in Riyadh, Saudi Arabia, organized by the Al-Berka Forum and Islamic Cooperation Center (OIC-AAC) Organization.

During the week, Justice Shah also wanted to perform Umrah before the start of the holy month of Ramadan.

The senior POS judge requested Pakistan’s Chief Justice Yahya Afridi for the former Pakistan departure over time, which was not answered, which was not answered, in which Justice Mansoor was forced to cancel the journey to Saudi Arabia because his address could not be approved.

It may be recalled that Justice Shah Riaz was the only Supreme Court judge in the program organized by the Saudis in the ‘Mediation Week’ in the ‘Mediation Week’, which is a high profile event.

Lawyers believe that mediation is the most important for Pakistan, and the presence of Justice Shah in Riyadh will help to cooperate with the judiciary of Muslim countries. Because of this, a joint arbitration center for Muslim countries and an international mediation center in Pakistan can be created.

He is also wondering why the minutes of the committee working under the Supreme Court Practice and Procedure Act 2023 are not being shared on the SC website. The exercise was stopped since the current CJP took over its office.

Justice Syed Mansoor Ali Shah is also a member of the three members of the committee. Earlier, four judges, who had opposed the High Court judges in the Apex Court, have been removed from the key management committees under the plan to reorganize Chief Justice Yahya Afridi.

CJP Afridi has restructured several committees, in which senior judges were replaced by junior. Those who were excluded from critical roles included Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Aisha Malik, Justice Uttar Manullah and Justice Akil Ahmed Abbasi.

Two judges, Justice Mansoor Ali Shah and Justice Muneeb Akhtar, who set up a majority in the relevant committee, ordered the hearing of the petitions in the first week of November. However, to select judges for the constitutional bench, CJP Afridi instead of making a list of the case, CJP Afridi called for a meeting of the Judicial Commission of Pakistan (JCP). The constitutional bench has not yet decided the petitions against the 26th constitutional amendment.

Subsequently, a bench of three judges, headed by Justice Shah, raised the question of whether a regular bench could be banned from deciding issues related to the law and the constitution after the 26th Constitutional Amendment. However, the matter was withdrawn from this regular bench by committees.

A division bench of the Apex Court, headed by Justice Syed Mansoor Ali Shah, said that members of the two committees violated the court order and withdrew the case from a regular bench. The bench remarked that members of the committees had insulted. Therefore, a complete court should be constituted to start the proceedings.

However, members of the constitutional bench were seemingly upset and put aside the court orders of the bench aside. Recently, the federal government also filed intra -court appeals against regular bench orders in a blasphemous case.

It is being observed that the controversial judges have always faced difficult times since the reign of former CJP Saqib Nasr.

Lawyers believe that if the confrontation between senior SC judges continues, the higher judiciary will be further weakened and the situation will be conducive to those who benefit from the 26th constitutional amendment.
