Islamabad High Court Justice Mohsin Akhtar Kayani while presiding over the hearing of the case of transfer of 10 kanal and 16 marla land in Karpa region of Islamabad strongly condemned the long delay in the case. “These long delays are avoidable,” he said, citing the inefficiency of the judicial system. Justice Kayani further said that the deadlocked cases, which take only hours to get results, often take years to dispose of them.
It took more than ten years to settle a simple land dispute,” he lamented. “Judges spent 10 years on a case that could have been disposed of in an hour,” he claimed. “Lawyers should not be part and parcel of this delay, as they are professional officers of the court,” the judge said.
While Justice Kayani acknowledged the legacy of the great judges of the judiciary, he lamented that incompetence and backlog of cases were still not addressed. He pointed out that while delaying the payment of taxes to the people unnecessarily, he raised the question that if it takes 10 years to solve a case, what is the fault of the people?
He said that more than 150 court appearances were required to prosecute the cases, which wasted time and tax money. He called for increasing professionalism and competence in judicial proceedings so that this waste does not happen again. Justice Kayani appealed to judges and lawyers to work together to deliver speedy and effective justice.
Earlier, the matter was heard by Additional Judge Muhammad Shabbir Bhatti and Judge Humayun Dilawar. After lengthy proceedings, Justice Kayani reserved the final judgment of the case under hearing.
The IHC judge slammed the judges for the delayed resolution of the case.
