ISLAMABAD: Former Prime Minister Imran Khan and his wife, Bashara Babi, have approached the Islamabad High Court (IHC) to hear a new court to hear an appeal against their acquittal in a controversial marriage case. The formation of the bench can be requested.

The case includes allegations that he was married during Basra Babi’s era, which was presented by Islamic law after divorce, which is forbidden to marry again.

The appeal was filed by Basra Babi’s ex -husband, Khawar Manika, who claims that the bad decision issued by an additional sessions court in July 2024 was wrong. During the hearing on Monday, Justice Azam Khan presided over the matter, presenting his arguments with the legal representatives of both sides.

Manika’s lawyer, Zahid Asif Chaudhry, argued that the real decision was legally baseless and urged the court to review the matter. In response, Imran Khan’s lawyer, Shoaib Shaheen, raised concerns about possible prejudice in the proceedings and suggested that the matter be re -assigned to a new bench.

Shaheen argued that “you have already made your position clear, and it would be better to hear the matter through a different panel.”

Recognizing these concerns, Justice Azam Khan announced that the case file would be handed over to Chief Justice Aamir Farooq, who would decide to create a new bench to hear the appeal.

The allegations arise from the claims that Imran Khan and Bashara Babi were married during the period of adulthood in violation of Islamic principles. In July 2024, the two were acquitted of the allegations, but the appeal tries to abolish the decision.

This legal challenge came when Imran Khan and Bashara Babi face legal problems. Earlier this month, he was sentenced in a high level al -Qadir trust case. Imran Khan was sentenced to 14 years in prison, while Bashra Babi was sentenced to seven years in prison. The court also imposed a fine and ordered the confiscation of the trust associated with the trust.

Imran Khan has been detained in Adiala jail for more than a year, and Bashara Bibi was taken into custody after a verdict in the trust case.

Chief Justice Aamir Farooq will now determine the formation of a new bench to ensure neutrality in the IDDAT case. The decision may have important implications, which could include another layer of complexity in the legal battles around the former prime minister and his wife.

In this case, the growing political and legal pressure facing Imran Khan and Bashara Babi has been highlighted, as their legal problems are dominated by the headlines.
