Islamabad: Three judges of the Supreme Court have written to Chief Justice Yahya Afridi and Chief Justice Aminuddin Khan for not deciding the issue of the powers of the bench in the court.

Justice Mansoor Ali Shah, Justice Ayesha Malik and Justice Aqeel Abbasi in the letter have referred to the bench’s powers in the case and have complained that the case was not decided on January 20, terming it as contempt of court.

“Justice Aqeel Abbasi was added to the bench on January 16, who had previously heard the case in the Sindh High Court,” the letter read.

The judges’ letter also referred to the Practice and Procedure Committee meeting on January 17. Justice Shah told the committee that his view was already on record. He refused to participate in the meeting of the committee and added that it is not necessary for him to be present in the committee.

“The committee could have reconstituted the earlier bench and fixed the hearing on January 20,” according to the letter. “Not settling the case in the court is tantamount to disobeying the court order”. “This non-compliance violates the law, and constitutes contempt of court,” according to the letter.

It should be noted that the Supreme Court bench headed by Justice Mansoor Ali Shah and comprising Justice Ayesha Malik and Justice Aqeel Abbasi issued a show cause notice to Additional Registrar Nazar Abbas on Monday. Fixing the matter of jurisdiction of Benches for hearing.
